Kenya Magistrates and Vetting Board Visits ILPD

On this Friday, 14th November 2014, The Judges and Magistrates Vetting Board was at the Institute of Legal Practice and Development for a study visit. Sharad Rao, the Chairperson of JMVB said that the establishment of the Board was in response to public opinion during the drafting of the new Kenyan constitution, when members of the public expressed mistrust in the judiciary. The Board was tasked to restore confidence in the judiciary in Kenya through a vetting process. Sharad Rao added that their visit was aiming at learning from Rwanda regarding how Rwanda recovered after the Genocide of Tutsi, the preservation of Gacaca archives and how the Rwanda Rwandan Judicial works. That is why the Board visitedsome Justice Sector Institutions including ILPD.“The fact that Rwanda has managed to provide justice towards crimes of the Genocide against Tutsi that happened in Rwanda in 1994, this makes Rwanda a good example for the region.” Said Rao. In Kenya, the different arms of the justice sector have been in intense interrogation resulting sometimes in reforms of the legal and institutional framework supporting the rule of law, the justice system, the executive, the legislative, the criminal justice system and the Bar. According to the commission of inquiry into post-Election violence (2008), in the disputed presidential poll in 2007 an estimated 1300 people were killed and 3500 000 displaced. There were also gross human rights violations including physical and sexual molestations, rape and restrictions of freedom of movement during the two months of inter-ethnic fighting. The Acting Rector of ILPD,AimableHavugiyaremyebriefed the delegation about the mission and academic programs of ILPD. He pointed out that ILPD was established in 2008 as part of the country’s push for law reform. He added that ILPD has played a vital role in Rwanda Justice Sector by providing professional skills based legal training to the Justice sector in Rwanda.Its remit also extends to promoting research and dissemination of the law. The delegation was given the opportunity to visit different departments of ILPD and to discuss with ILPD students. At the end of its study visit at ILPD, JMVB appreciated the role ILPD is playing in Rwandan Justice Sector andsaid that they got more insights about the Rwandan Justice which may assist them to restore confidence in Kenyan Judiciary.
